Terms of Service

1. Acceptance of terms

By connecting a wallet, submitting a build, or otherwise using the Service, you confirm that you are at least the age of majority in your jurisdiction and that you have the authority to agree to these Terms. If you do not agree, do not use the Service.

2. The service

Hype-P orchestrates multiple third-party AI models (such as those from OpenAI, Anthropic, and Google) to plan, write, review, and assemble digital deliverables. Output is generated automatically and may vary in quality, accuracy, and originality. The Service is provided on an “as is” and “as available” basis.

We may add, change, or remove features at any time, and we may impose limits on usage, concurrency, or resource consumption to keep the Service running for everyone.

3. Wallet accounts

You authenticate by connecting a self-custodied blockchain wallet and signing a message (Sign-In With Ethereum). Your wallet address is your account identifier. You are solely responsible for the security of your wallet, private keys, and seed phrase. We never take custody of your wallet and cannot recover it if you lose access.

• You are responsible for all activity that occurs under your wallet.
• You must not share access to your session or impersonate another wallet holder.
• We are not responsible for losses arising from compromised wallets or lost keys.

4. Credits & payments

Builds consume credits. New accounts may receive a one-time free credit grant. Additional credits can be purchased with USDC on the Base network by transferring the exact amount shown to the treasury address displayed at checkout.

• Credits are a prepaid, limited-use license to access compute and model capacity. They have no cash value, are not securities, and are non-transferable.
• Blockchain payments are final and irreversible. Once a transaction is confirmed on-chain, it cannot be reversed by us. Credits are granted only after the transaction is verified on-chain with sufficient confirmations.
• You are responsible for sending the correct token (native USDC on Base) and amount. Funds sent in the wrong token, on the wrong network, or in the wrong amount may be unrecoverable.
• Except where required by law, credits and payments are non-refundable. Credits consumed by a build are not refunded even if you are dissatisfied with the output.

5. Your API keys (BYOK)

Some configurations let you supply your own third-party API keys (“bring your own key”). If you do, you are responsible for those keys, for any charges the third party bills you, and for complying with that provider’s terms. You represent that you are authorized to use any key you provide.

Keys you enter in your browser are stored locally on your device and transmitted only to perform the builds you request. See the Privacy Policy for details on how keys are handled.

6. Generated content & ownership

As between you and us, and to the maximum extent permitted by law and by the underlying model providers’ terms, you own the output generated for your builds and may use it for any lawful purpose, including commercially.

• You are responsible for reviewing output before use. AI-generated code and content may contain errors, insecure patterns, or material that infringes third-party rights.
• Output may incorporate third-party assets (for example, stock images) that carry their own license and attribution requirements. You must comply with those requirements.
• Similar prompts may produce similar output for different users. We do not guarantee that output is unique or free of third-party rights.
• You grant us a limited license to process your prompts and store your builds solely to operate and improve the Service.

7. Acceptable use

You agree not to use the Service to:

• generate or distribute unlawful, infringing, harmful, or deceptive content;
• produce malware, phishing pages, or content intended to defraud or harm others;
• violate the rights of others, including intellectual property and privacy rights;
• circumvent usage limits, security controls, or the credit system;
• reverse engineer, resell, or abuse the Service or the underlying model providers.

We may suspend or terminate access for violations.

8. Third-party services

The Service relies on third parties, including AI model providers, image providers, RPC providers, and the Base blockchain. We do not control these services and are not responsible for their availability, performance, terms, or actions. Your use of them may be subject to their own terms.

9. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

Nothing on the Service is financial, investment, legal, or tax advice. We are not a broker, exchange, or financial advisor. Digital assets are volatile and their use carries risk. You are solely responsible for your decisions.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPE-P AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, DIGITAL ASSETS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Your continued use after changes take effect constitutes acceptance.
